Attached is our standard Mechanic’s Lien form. We try to set forth how to file a lien in New York. Consultation with an attorney is always recommended. However, an attorney is not required. The form itself is pretty self-explanatory but there are a few key things to remember:
1: Complete the New York Mechanic’s Lien Form, all of the fields: NY Mechanic’s Lien – Flexible Form
2: Complete the Lien Verification Form: Client Verification of Lien
3: File your lien with the County Clerk’s office (in the county where the property is located) and pay the lien filing fee.
4: Serve a copy of the mechanic’s lien on the contractor that hired you and the property owner as well, assuming they are two different people or entities.
5: Complete the affidavit of service of the lien (you’ll need one for each person/entity that you serve): Affidavit of Service
5: File the affidavit of service for the lien, with the County Clerk’s office and pay the affidavit of service filing fee.
